According to Ug News Media Europe,Large-scale reforms that have been implemented in our country for several years are already clearly manifesting themselves in all areas of life. This picture is clearly manifested in all spheres of activity, including spheres of activity related to state administration, as well as in the legislative acts adopted in the first years of our independence, which today do not meet modern requirements. Today’s Azerbaijan is completely different from 30 years ago. At present, our country is a rapidly developing country that has become a leader in the world.Therefore, there is a need to improve the laws adopted in previous years and adapt them to international norms. In this regard, the creation of the new Law “On Political Parties” was based on the requirements of the time.
Chairman of the Democracy and Human Rights Committee, Doctor of Philosophy in Law Chingiz Ganizadeh expressed these views in his statement to Ug News MEDIA EUROPE.Commenting on the adoption of the new Law “On Political Parties”, the human rights defender said that this is the next manifestation of the reforms implemented in the country. The reforms brought our country to a new stage of development and further strengthened Azerbaijan’s position in the world community. As a result of the reforms carried out so far, the successes achieved in all areas are clearly evident. Currently, Azerbaijan has entered a new stage of development. At such a time, I welcome the adoption of the new Law “On Political Parties”. The Law of the Republic of Azerbaijan “On Political Parties”, which has already expired, was adopted 30 years ago – on June 3, 1992. The new political configuration formed in the country made it necessary to take necessary steps by the Milli Majlis to improve the political system in the field of legislation. In this regard, the representatives of all political parties represented in the Milli Majlis had to apply to the Chairman of the Milli Majlis for the preparation of a new draft law “On Political Parties”.
Ch. Ganizadeh said that during the preparation of the new draft law, the “Situation on the Legal Regulation of the Activities of Political Parties” adopted by the Venice Commission in 2010, “The Law of Ukraine” adopted by the Venice Commission and the OSCE Bureau for Democratic Institutions and Human Rights in 2021 Joint opinion on the draft of the Law on Political Parties”, the experience of 24 developed countries, more than 250 proposals submitted in written form to the Milli Majlis by 47 of the political parties operating in the country, including more than 100 proposed by the deputies in committee and plenary sessions in the parliament. Many suggestions are considered.The chairman of the committee said that during the preparation of this draft law, for the first time in the history of the Milli Majlis, the document was posted on the website of the parliament for opinions and suggestions, and a public opinion poll was conducted by the Social Research Center on the main issues reflected in the draft. Considering the public importance of the document, 2 public hearings were organized with the participation of political parties, non-governmental organizations, political scientists and media representatives regarding the proposed project. After the hearings, up to 70 positive additions and changes were made, and after the committee and plenary meetings in the Milli Majlis, up to 40 additions and changes were made. In total, 110 amendments were made to the document.The human rights defender also mentioned the highlights of the new law. He said that after the adoption of the new law, everyone has an equal right to form a political party or join an existing political party. Free activity of all state-registered political parties is guaranteed. Also, the state ensures the establishment of political parties and the implementation of their activities, as well as the creation of legal conditions equal to the observance of their rights and legal interests. One of the main points is financial assistance to political parties at the expense of the state budget. State and local self-government bodies and officials are not allowed to interfere in the activities of political parties, except for cases provided by law. C. Ganizade said that The activities of political parties that violate the Constitution of the Republic of Azerbaijan and the laws of the Republic of Azerbaijan can be terminated only by court order: “I would like to mention one more democratic feature. Disputes related to the state registration, suspension and cancellation of the political party are considered by the appeals court. At the same time, the establishment and activities of political parties with different goals are reflected in the law,” he said.C. Ganizade emphasized that, unlike the previous law, the new law allows the political party to engage in entrepreneurial activities related to the preparation and sale of social and political publications, other propaganda and campaign materials. A political party may create or participate in economic societies to engage in permitted types of entrepreneurial activity, as well as to establish print media (be a participant in print media) in accordance with the Law of the Republic of Azerbaijan “On Media”.
